2. Objeto y aceptación

Los presentes Términos y Condiciones ("Términos") regulan el acceso y uso de la aplicación móvil Xplore ("la Aplicación") y de los servicios asociados ofrecidos por XPLORE APP, S.L. ("Xplore", "nosotros" o "la empresa").

El acceso y uso de la Aplicación implica la aceptación expresa e íntegra de los presentes Términos. Si no estás de acuerdo con alguno de ellos, debes abstenerse de usar la Aplicación. Estos Términos deben leerse conjuntamente con nuestra Política de Privacidad, que forma parte integrante del acuerdo.

3. Edad mínima

El uso de la Aplicación está reservado a personas mayores de 16 años. Al registrarte, declaras y garantizas que tienes al menos 16 años.

Si Xplore tuviera conocimiento de que un usuario es menor de 16 años, cancelará su cuenta y eliminará sus datos. Si tienes conocimiento de que un menor de 16 años ha creado una cuenta, notifícalo a xploream@gmail.com.

4. Registro y cuenta de usuario

Para acceder a las funcionalidades principales es necesario crear una cuenta. Eres responsable de:

• Mantener la confidencialidad de tus credenciales de acceso.
• Toda la actividad realizada desde tu cuenta.
• Notificarnos de forma inmediata cualquier acceso no autorizado en xploream@gmail.com.

No está permitido crear más de una cuenta personal ni suplantar la identidad de otra persona. Xplore se reserva el derecho a suspender o cancelar cuentas que incumplan los presentes Términos, sin necesidad de previo aviso en casos de infracción grave.

5. Contenido generado por los usuarios (CGU)

La Aplicación permite crear, publicar y compartir planes de viaje, vídeos, fotos, reseñas y otro material ("Contenido").

5.1. Licencia que nos otorgas

Al publicar Contenido, concedes a Xplore una licencia no exclusiva, gratuita, mundial, sublicenciable y transferible para usar, reproducir, distribuir, modificar, mostrar públicamente y ejecutar ese Contenido, únicamente con el fin de operar, desarrollar y promover el Servicio. Esta licencia termina cuando eliminas el Contenido o tu cuenta, salvo que haya sido compartido o guardado por otros usuarios. Conservas en todo momento todos tus derechos de propiedad intelectual.

5.2. Declaraciones y garantías

Al publicar Contenido, declaras y garantizas que:

• Eres el autor o titular, o dispones de todos los derechos necesarios.
• El Contenido no infringe derechos de propiedad intelectual, privacidad, honor ni imagen de terceros.
• El Contenido cumple con la legislación aplicable y con los presentes Términos.

6. Contenido prohibido

Está terminantemente prohibido publicar Contenido que:

• Contenga desnudez, pornografía o material sexualmente explícito.
• Promueva, muestre o incite a la violencia, el odio o la discriminación por razón de raza, etnia, religión, género, orientación sexual, discapacidad u otras características protegidas.
• Constituya acoso, amenazas, intimidación o conducta abusiva hacia otras personas.
• Sea spam, publicidad no solicitada, phishing o contenido engañoso o fraudulento.
• Contenga información falsa, difamatoria o que pueda inducir a error.
• Infrinja derechos de autor, marcas registradas u otros derechos de propiedad intelectual.
• Vulnere la privacidad de terceros.
• Viole cualquier ley o normativa aplicable.

7. Moderación y reportes

7.1. Mecanismo de reporte

Los usuarios pueden reportar Contenido que consideren inadecuado a través de los mecanismos de reporte disponibles en la Aplicación. Los reportes pueden referirse a vídeos, publicaciones o cuentas de otros usuarios.

7.2. Revisión y resolución

Xplore revisará los reportes recibidos en un plazo razonable. Las decisiones sobre la eliminación de Contenido o la suspensión de cuentas corresponden exclusivamente a Xplore. No estamos obligados a supervisar de forma activa y continua todo el Contenido, pero actuaremos con diligencia cuando tengamos conocimiento efectivo de una infracción.

7.3. Acciones posibles

Ante una infracción, Xplore podrá adoptar, sin limitación:

• Eliminar el Contenido infractor.
• Emitir un aviso al usuario.
• Suspender la cuenta temporalmente.
• Cancelar la cuenta de forma permanente.
• Comunicar la infracción a las autoridades competentes cuando la ley lo exija.

8. Suspensión y cancelación de cuentas

Xplore puede suspender o cancelar tu cuenta, temporal o permanentemente, si:

• Incumples los presentes Términos.
• Tu comportamiento causa perjuicio a otros usuarios, terceros o a la plataforma.
• Usas la Aplicación para fines ilegales o fraudulentos.
• Así lo requiere una obligación legal o resolución judicial.

Puedes cancelar tu cuenta en cualquier momento desde Ajustes → Privacidad → Eliminar mi cuenta. La eliminación conllevará la supresión de tus datos personales conforme a nuestra Política de Privacidad.

9. Integraciones de terceros

La Aplicación integra servicios de terceros. Su uso está sujeto a sus propias condiciones:

• TikTok (ByteDance) — Términos de Uso de TikTok
• Meta / Instagram — Condiciones del Servicio de Meta
• Google Maps / Places — Términos de Servicio de Google

Xplore no se hace responsable del contenido, la disponibilidad ni las prácticas de privacidad de estos servicios.

10. Propiedad intelectual de Xplore

La Aplicación, su diseño, interfaz, código fuente, algoritmos, marcas comerciales, logotipos y demás elementos son propiedad de XPLORE APP, S.L. o de sus licenciantes y están protegidos por la legislación española e internacional sobre propiedad intelectual. No se concede ningún derecho ni licencia sobre dichos elementos más allá del uso estrictamente necesario para utilizar la Aplicación.

11. Exclusión y limitación de responsabilidad

La Aplicación se ofrece "tal cual" y "según disponibilidad". Xplore no garantiza la continuidad, disponibilidad ni ausencia de errores del Servicio. El Contenido publicado por los usuarios es responsabilidad exclusiva de quien lo publica; Xplore no lo revisa antes de su publicación ni garantiza su veracidad o adecuación.

En la medida máxima permitida por la legislación española, Xplore no será responsable de los daños indirectos, incidentales, especiales, punitivos o consecuentes derivados del uso o la imposibilidad de uso del Servicio. Nada en estos Términos excluye ni limita la responsabilidad de Xplore en los supuestos en que dicha exclusión no esté permitida por la legislación española obligatoria.

12. Modificaciones de los Términos

Xplore puede modificar los presentes Términos en cualquier momento. Te notificaremos los cambios materiales con al menos 15 días de antelación mediante un aviso visible en la Aplicación y/o por correo electrónico. El uso continuado de la Aplicación tras la entrada en vigor de los nuevos Términos implica su aceptación.

13. Ley aplicable y jurisdicción

Los presentes Términos se rigen por la legislación española. Para la resolución de cualquier controversia, las partes se someten expresamente a los Juzgados y Tribunales de Madrid, con renuncia a cualquier otro fuero, sin perjuicio de lo previsto por la normativa de protección a los consumidores.

2. Scope and acceptance

These Terms and Conditions ("Terms") govern access to and use of the Xplore mobile application ("the App") and associated services provided by XPLORE APP, S.L. ("Xplore", "we", "us", or "our").

By accessing or using the App, you expressly accept these Terms in full. If you do not agree with any part of them, you must refrain from using the App. These Terms should be read together with our Privacy Policy, which forms an integral part of the agreement.

3. Minimum age

Use of the App is restricted to individuals aged 16 or over. By registering, you declare and warrant that you are at least 16 years old.

If Xplore becomes aware that a user is under 16, it will cancel their account and delete their data. If you are aware that a person under 16 has created an account, please notify us at xploream@gmail.com.

4. Registration and user account

Most features of the App require a registered account. You are responsible for:

• Keeping your login credentials confidential.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorised access at xploream@gmail.com.

You may not create more than one personal account or impersonate any other person. Xplore reserves the right to suspend or terminate accounts that breach these Terms, without prior notice in cases of serious infringement.

5. User-generated content (UGC)

The App allows users to create, post, and share travel plans, videos, photos, place reviews, and other material ("Content").

5.1. Licence you grant us

By posting Content, you grant Xplore a non-exclusive, royalty-free, worldwide, sublicensable and transferable licence to use, reproduce, distribute, modify, publicly display, and perform that Content, solely for the purpose of operating, developing, and promoting the Service. This licence ends when you delete the Content or your account, except where Content has been shared with or saved by other users. You retain all intellectual property rights in your Content at all times.

5.2. Representations and warranties

By posting Content, you represent and warrant that:

• You are the creator or owner, or have all necessary rights to post it.
• It does not infringe any third-party intellectual property, privacy, honour, or image rights.
• It complies with applicable law and these Terms.

6. Prohibited content

You may not post or share Content that:

• Contains nudity, pornography, or sexually explicit material.
• Promotes, depicts, or incites violence, hatred, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
• Constitutes harassment, threats, intimidation, or abusive behaviour.
• Constitutes spam, unsolicited advertising, phishing, or deceptive content.
• Contains false, misleading, or defamatory statements.
• Infringes copyright, trademarks, or other intellectual property rights.
• Violates third-party privacy.
• Violates any applicable law or regulation.

7. Moderation and reporting

7.1. Reporting mechanism

Users may report Content they consider inappropriate through the reporting tools available in the App. Reports may refer to videos, posts, or other users' accounts.

7.2. Review and resolution

Xplore will review reports within a reasonable timeframe. Decisions on Content removal or account suspension rest exclusively with Xplore. We are not obliged to actively and continuously monitor all Content, but will act diligently upon obtaining actual knowledge of an infringement.

7.3. Available actions

In response to a breach, Xplore may take, without limitation:

• Remove the infringing Content.
• Issue a warning to the user.
• Temporarily suspend the account.
• Permanently terminate the account.
• Report the infringement to the competent authorities where required by law.

8. Account suspension and termination

Xplore may suspend or terminate your account, temporarily or permanently, if:

• You breach these Terms.
• Your behaviour causes harm to other users, third parties, or the platform.
• You use the App for illegal or fraudulent purposes.
• Required by a legal obligation or judicial order.

You may delete your account at any time from Settings → Privacy → Delete my account. Deletion will result in the erasure of your personal data in accordance with our Privacy Policy.

9. Third-party integrations

The App integrates third-party services. Their use is subject to their own terms:

• TikTok (ByteDance) — TikTok Terms of Service
• Meta / Instagram — Meta Terms of Service
• Google Maps / Places — Google Terms of Service

Xplore is not responsible for the content, availability, or privacy practices of these services.

10. Xplore's intellectual property

The App, its design, interface, source code, algorithms, trademarks, logos, and other elements are the property of XPLORE APP, S.L. or its licensors and are protected by Spanish and international intellectual property law. No right or licence is granted over those elements beyond what is strictly necessary to use the App.

11. Disclaimer and limitation of liability

The App is provided "as is" and "as available". Xplore does not warrant the continuity, availability, or error-free operation of the Service. Content posted by users is the sole responsibility of the person who posts it; Xplore does not review Content before publication and does not guarantee its accuracy or appropriateness.

To the maximum extent permitted by applicable Spanish law, Xplore will not be liable for any indirect, incidental, special, punitive, or consequential damages arising from or inability to use the Service. Nothing in these Terms excludes or limits Xplore's liability where such exclusion is not permitted by mandatory Spanish law.

12. Amendments

Xplore may amend these Terms at any time. We will notify you of material changes at least 15 days in advance via a prominent notice in the App and/or by email. Continued use of the App after the new Terms take effect constitutes acceptance of the changes.

13. Governing law and jurisdiction

These Terms are governed by Spanish law. Any dispute arising out of or in connection with these Terms shall be submitted exclusively to the Courts and Tribunals of Madrid, with express waiver of any other jurisdiction, without prejudice to the rights of consumers under applicable consumer protection law.
