Política de Copyright (DMCA) y DSA
Este documento se ofrece en español e inglés. En caso de discrepancia, prevalece la versión en español, salvo en lo relativo al procedimiento DMCA de Estados Unidos, que se rige por la versión en inglés.
1. Compromiso con los derechos de autor
XPLORE APP, S.L. («Xplore») respeta los derechos de propiedad intelectual de terceros y espera que sus usuarios hagan lo mismo. Xplore actúa como prestador de servicios de alojamiento de contenido generado por los usuarios y se acoge a los puertos seguros («safe harbors») aplicables, incluido el previsto en la sección 512 de la Digital Millennium Copyright Act (DMCA) de los Estados Unidos y el régimen de responsabilidad de los prestadores de servicios intermediarios de la UE (Reglamento (UE) 2022/2065, «DSA»).
Retiraremos o bloquearemos el acceso al material presuntamente infractor con arreglo al procedimiento descrito a continuación y aplicaremos una política de cancelación de las cuentas de los infractores reincidentes.
2. Agente designado (DMCA)
Las notificaciones de presunta infracción de derechos de autor deben dirigirse a nuestro Agente Designado de Copyright:

Este contacto es exclusivamente para notificaciones de infracción de derechos de autor. Cualquier otra consulta enviada al Agente Designado no recibirá respuesta.
3. Cómo presentar una notificación de retirada válida
Para que una notificación de retirada sea válida conforme a la sección 512(c)(3) de la DMCA, debe incluir sustancialmente los seis elementos siguientes:
- La firma física o electrónica del titular de los derechos o de la persona autorizada para actuar en su nombre.
- La identificación de la obra protegida por derechos de autor presuntamente infringida.
- La identificación del material presuntamente infractor y la información suficiente para localizarlo (URL o ubicación dentro de la aplicación).
- Los datos de contacto de la parte reclamante (nombre, dirección, correo electrónico y teléfono).
- Una declaración de buena fe de que el uso del material no está autorizado por el titular de los derechos, su agente o la ley.
- Una declaración de que la información de la notificación es exacta y, bajo pena de perjurio, de que la parte reclamante está autorizada para actuar en nombre del titular.

Advertencia: conforme a la sección 512(f) de la DMCA, quien tergiverse de forma consciente y sustancial que un material es infractor puede incurrir en responsabilidad por daños y perjuicios.
4. Proceso de notificación y retirada
- Al recibir una notificación, registramos la fecha de recepción.
- Si la notificación es válida, retiraremos o bloquearemos el acceso al material presuntamente infractor sin dilación indebida.
- Registramos la fecha de retirada y notificaremos al usuario afectado que su contenido ha sido retirado, junto con la información necesaria para presentar una contranotificación.
- Podemos solicitar aclaraciones si la notificación está incompleta antes de actuar.
5. Contranotificación (sección 512(g))
Si consideras que tu contenido fue retirado por error o por una identificación errónea, puedes presentar una contranotificación. Conforme a la sección 512(g) de la DMCA, debe incluir los cinco elementos siguientes:
- Tu firma física o electrónica.
- La identificación del material retirado y de la ubicación en la que aparecía antes de su retirada.
- Una declaración, bajo pena de perjurio, de que crees de buena fe que el material se retiró por error o por una identificación errónea.
- Tu nombre, dirección y número de teléfono.
- Tu consentimiento a la jurisdicción del tribunal federal de distrito competente (o, si resides fuera de Estados Unidos, de un foro acordado) y la aceptación de la notificación de emplazamientos de la parte reclamante.
Puedes presentar tu contranotificación desde la propia aplicación (cuando tu contenido haya sido retirado) o por correo electrónico al Agente Designado.
Reenvío y plazo de restablecimiento: reenviaremos tu contranotificación a la parte reclamante. Si esta no nos comunica en un plazo de 10 a 14 días hábiles que ha interpuesto una acción judicial dirigida a impedir la actividad infractora, podremos restablecer el material retirado.
Aviso sobre datos personales (RGPD): la ley de EE. UU. exige compartir tu contranotificación (incluidos tu nombre y datos de contacto) con la parte reclamante, y viceversa. Al presentar una notificación o contranotificación, entiendes y aceptas que tus datos podrán ser comunicados a la otra parte a estos efectos. Minimizamos los datos compartidos a lo estrictamente necesario para tramitar la reclamación.
6. Política de infractores reincidentes
Xplore aplica una política de cancelación de cuentas de infractores reincidentes. Las notificaciones válidas de infracción de derechos de autor dan lugar a un «strike» (aviso) en la cuenta correspondiente. Al acumular 3 avisos activos, la cuenta se suspenderá y podrá ser cancelada de forma permanente, sin perjuicio de otras medidas que Xplore pueda adoptar según sus Términos y Condiciones.
7. Reglamento de Servicios Digitales de la UE (DSA)

1. Commitment to copyright
XPLORE APP, S.L. ("Xplore") respects the intellectual property rights of others and expects its users to do the same. Xplore acts as a hosting provider of user-generated content and relies on the applicable safe harbors, including the one set out in Section 512 of the U.S. Digital Millennium Copyright Act (DMCA) and the intermediary-liability regime of the EU (Regulation (EU) 2022/2065, "DSA").
We will remove or disable access to allegedly infringing material in accordance with the process described below and will terminate the accounts of repeat infringers.

This contact is solely for copyright infringement notices. Any other inquiry sent to the Designated Agent will not receive a response.
3. How to file a valid takedown notice
For a takedown notice to be valid under Section 512(c)(3) of the DMCA, it must include substantially the following six elements:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing and information reasonably sufficient to locate it (URL or in-app location).
- Contact information for the complaining party (name, address, email, and telephone number).
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
You may submit your notice through our web takedown form or by email to the Designated Agent listed in Section 2.
Warning: under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be liable for damages.
4. Notice-and-takedown process
- Upon receiving a notice, we log the date of receipt.
- If the notice is valid, we will remove or disable access to the allegedly infringing material without undue delay.
- We log the date of removal and will notify the affected user that their content has been removed, along with the information needed to submit a counter-notification.
- We may request clarification if a notice is incomplete before taking action.
5. Counter-notification (Section 512(g))
If you believe your content was removed by mistake or misidentification, you may submit a counter-notification. Under Section 512(g) of the DMCA, it must include the following five elements:
- Your physical or electronic signature.
- Identification of the material that was removed and the location at which it appeared before it was removed.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number.
- Your consent to the jurisdiction of the appropriate U.S. federal district court (or, if you reside outside the U.S., an agreed forum) and acceptance of service of process from the complaining party.
You may submit your counter-notification from within the app (when your content has been removed) or by email to the Designated Agent.
Forwarding and reinstatement window: we will forward your counter-notification to the complaining party. If they do not notify us within 10 to 14 business days that they have filed a court action seeking to restrain the infringing activity, we may reinstate the removed material.
Personal-data note (GDPR): U.S. law requires us to share your counter-notification (including your name and contact details) with the complaining party, and vice versa. By submitting a notice or counter-notification, you understand and agree that your information may be disclosed to the other party for this purpose. We minimize the data shared to what is strictly necessary to process the claim.
6. Repeat-infringer policy
Xplore maintains a repeat-infringer termination policy. Valid copyright infringement notices result in a "strike" against the relevant account. Upon accumulating 3 active strikes, the account will be suspended and may be permanently terminated, without prejudice to any other measures Xplore may take under its Terms and Conditions.
7. EU Digital Services Act (DSA)
